4 Steps to Follow After a Car Accident Injury in Illinois

Web Admin - Thursday, October 17, 2019
Palatine car accident attorneyBefore a motorist or passenger gets into a vehicle, the possibility of a car accident must be taken into consideration. Victims of a fender bender may need to deal with pain and suffering, financial repercussions, and medical complications. If the crash can be attributed to the negligence of another individual, compensation may be owed to the injured parties. A lot of confusion may result after an accident, leaving the wounded parties unsure about how to proceed. These steps can provide guidance and clarity to anyone involved in a car accident:

1. Think About Safety

Immediately following an accident, the safety and well-being of yourself and your passengers should be addressed. If a serious injury has occurred, try to remain still until medical assistance arrives. If possible, try to move your car to the side of the road with your hazard lights on, and the use of cones, warning markers, or flares could provide additional safety. After addressing your own safety concerns, you may want to check on the welfare of others involved in the accident.

2. Seek Help

Whether the crash is a minor accident or a major collision, you should contact the police to report the incident. Police officers will come to the scene of the crash and provide an incident report that can help establish who is at fault. Additionally, the presence of law enforcement may deter the person responsible for the collision from fleeing the scene.

Visiting a hospital or seeing a doctor following a collision can ensure that you receive the proper medical treatment, and it can provide insight about how the accident may affect your long-term well-being. Car crashes can result in serious injuries that might remain dormant for an extended period of time. Seeking medical help will create a record of your injuries that can determine how your life will be affected.

3. Exchange Information and Gather Evidence

While waiting for law enforcement to arrive, the following information should be exchanged between everyone involved in an accident:
- Names and contact information
- Vehicle descriptions (make, model, year)
- License plate and driver's license numbers
- Insurance information

You should also obtain any evidence that could be used to determine fault for the collision, including:

- Eyewitness contact information and statements
- Pictures of the scene
- Pictures of any damage to vehicles
- Pictures of any injuries sustained
- The police officer’s name and badge number

Furthermore, it is important not to sign any documents other than what is requested by the police. Do not accept payment from another driver or sign any statements regarding fault for the accident.

4. Contact a Schaumburg Personal Injury Lawyer

While you will likely be able to make an insurance claim with the other driver’s insurance company or under your own policy, you should contact an attorney before speaking to an insurance company. At Drost, Gilbert, Andrew & Apicella, LLC, we can help you determine the full extent of your damages, and we can negotiate a settlement with insurance companies to ensure that you are fully compensated for your injuries and damages. If necessary, we can help you file a personal injury lawsuit to recover the compensation you deserve.

A car accident injury can result in loss of future wages, unforeseen medical expenses, and physical and emotional pain and suffering. If you have been injured because of another driver’s negligence, our experienced Palatine car accident attorneys will work with you to seek the compensation you are owed. McDonald’s Salads Linked to Food Poisoning Cases in Illinois

Web Admin - Thursday, July 19, 2018
Crystal Lake food poisoning injury attorneyEating food purchased from a restaurant or grocery store should not be a risky proposition, but in recent weeks, a number of Illinois residents and people in nearby states have become seriously ill after doing so. Dozens of cases of food poisoning have been reported and linked to salads sold at McDonald’s restaurants, and the problem is becoming more widespread, affecting people in several states throughout the Midwest. If you have experienced food poisoning because of contaminated salads or other foods, you should be sure to understand your options for recovering compensation for your damages.

The Dangers of Contaminated Salads and Produce

The current food poisoning case involves the Cyclospora parasite, which can cause intestinal illnesses to those who consume it. Infections from this type of organism are known as cyclosporiasis, and symptoms include explosive diarrhea, nausea, vomiting, stomach pain or cramps, gas, fatigue, loss of appetite, weight loss, headaches, and fever.

Cyclospora can be transmitted in fresh produce because these foods do not go through a cooking process that would kill the parasites. Washing or rinsing produce is not sufficient to remove these organisms.

After more than 100 reported cases of cyclosporiasis, McDonald’s has opted to remove salads from any restaurants that may have been affected by the outbreak. More than 3,000 restaurants are involved, and in addition to Illinois, people in Iowa, Wisconsin, Minnesota, and Missouri may have been in danger of contamination.

This is not the only case of food poisoning from Cyclospora which occurred recently. In June, vegetable trays produced by Del Monte were found to be the source of an outbreak that affected more than 200 people in Wisconsin, Iowa, Michigan, and Minnesota. The company recalled several products from grocery stores in states throughout the Midwest. This outbreak appears to be unrelated to the contaminated salads from McDonald’s.

Dealing with Emotional Trauma After an Auto Accident

Web Admin - Tuesday, July 11, 2017

Des Plaines auto accident lawyersCar accidents can cause more than just physical injuries. In fact, many victims experience emotional trauma in the weeks and months following an accident. Sadly, they may also face a difficulty when trying to cope with heightened emotions amidst the physical ailments and financial troubles that may accompany an accident. Learn how you can deal with emotional trauma after an auto accident, and what it could mean for your personal injury case, with help from the following information. You shall also learn where to find assistance with your claim.

Why Trauma May Occur

Most people assume that trauma is directly correlated with the severity of a crash or the injuries sustained. However, nothing could be further from reality. In fact, even minor accidents can cause heightened emotions and trauma. This is because trauma is often caused by fear, a lack of control, and a sudden or unexpected negative event. Car accidents contain all three elements.

Another reason that trauma is common after an accident is the speed at which the events occur. One minute, you can be driving through an intersection, and the next, you are spinning in the middle of traffic because someone ran a red light and hit you. Your brain may not fully process everything at the time, so it may attempt to do so afterward.

What Trauma Feels Like

Trauma is different for everyone. However, most people experience similar symptoms. For example, someone experiencing trauma after an accident might experience:

- Sleeplessness,
- Night terrors,
- Excessive irritability,
- Mood swings,
- Depression,
- Panic attacks,
- Night sweats,
- Confusion or difficulty concentrating,
- Inability to drive,
- Excessive fatigue,
- Difficulty relaxing,
- Helplessness,
- Social withdrawal or self-isolation,
- Racing heartbeat,
- Headaches or migraines,
- Abdominal pain or discomfort,
- Exaggerated startle response,
- Forgetfulness,
- Muscle tension or pain,
- Crying spells, or
- Flashbacks.

Please note that this list is, by no means, comprehensive. If you experience any strange or new symptoms after an accident, speak with your doctor to determine if it could be related.

How Trauma Could Impact Your Case

If you are experiencing trauma after an auto accident, you may be entitled to additional compensation. Unfortunately, proving that the effect was, in fact, caused by the accident can be difficult. As such, victims are encouraged to seek legal assistance from an experienced attorney.

Known for protecting the interests of our clients, Drost, Gilbert, Andrew & Apicella, LLC is the firm to call when you need help with your claim. Dedicated and experienced, our Des Plaines car crash lawyers will fight aggressively to ensure you get the compensation you deserve. Schedule your personalized consultation to learn more.
